the Dred Scott decision. They might be free after the Civil War, but that did not mean the individual states had to grant them the rights of citizenship within the borders of that state. That precedent (and we know how holy some view precedent) had not been removed legally by the Emancipation Proclamation or the Civil War itself.
Section 1 specifically gave former slaves citizenship of the United States and the citizenship of the state in which they resided.
Whether it means birthright citizen to people who are born on US soil of parents not citizens is the question now. It has been considered that for a long time, but we will see what this challenge leads to for the future.
