I agree 100%. ANd as long as it is private money, the Alston decision will be in effect. The problem is that if the House Settlement is ratified, then each University will be obligated to pay $20.5 million per year to its student athletes. Many of them want to funnel the NIL that is already being paid through the University, so they can count the NIL against the settlement obligation (since they are already paying it). That is where things change, and Title 9 becomes an issue. Universities don't want to pay $20 million a year in NIL, and then another $20 million in settlement money. Who the NIL is really coming from is not always clear, and that muddies the issue even more.
