It appears as if they constructed that settlement to use funds from TV and ticket sales to be free of Title 9 requirements.

Some very smart attorneys (Jeffrey Kessler, etc.) are working on that settlement and want this case to be settled and get paid sooner rather than later, so they had to anticipate this type of move and tried to protect against it.
