I haven't been following the trial closely, mostly just seeing posts on here, but started paying a bit more attention when the trial was close to its conclusion. Both of the questions you mentioned did seem to be in dispute.

1. Do any of you still question the jury instructions not in writing

If I recall, the instructions were pretty complex and were some 35 or 50 pages long. The state website said that it was generally a good idea to give the instructions to the jurors in writing and listed some reasons for that. They didn't require doing so however, and said that the defendant could request that they not be in writing.

Why were they not given in writing? Was that because of a defense request?

2. the nature of the crimes

As I understand it, the primary crime was falsifying his accounting records, but
A. that was a misdemeanor unless it was to cover up another crime
B. it was past the statute of limitations

a. What was the reason that the statute of limitations was waived or ignored or whatever?
b. What in your opinion was the underlying crime that the misclassification of the payment was covering up?

Why did the judge not require unanimity among the jury regarding what that underlying crime might be?

Also, what are your prognostications regarding where this case will go from here? It will undoubtedly be appealed, probably to both the state appeals court and there will probably also be a direct appeal to the Supreme Court to adjudicate it, bypassing the state appeals process.

1. Do you think the Supreme Court will accept the direct appeal?

if not

2. What do you think the NY Appeals Court will decide?

If they uphold the verdict

3. A. Will the Supreme Court take the appeal?
B. What do you think they will decide?
