The issue is the nature of the laws and the rights they would protect. It's actually incredibly simple and he's working hard to make it not so.
Enforcement and consequences are an entirely distinct topic worthy of discussion and far less easy to clarify than the nature of rights, positive and negative, and the laws which create or protect them, respectively.
