federal law prevent him from possessing the materials? Did they not request he return them when it was discovered he improperly took them? Had he not complied, and only partially returned the documents? Was there any reasonable or logical explanation or past precedence that would indicate he would willingly comply on his own?

They are doing it as much for his own protection than anything. If he was reasonably trustworthy and competent it wouldn't have reached this point.
