I don't think his argument is "I didn't get hired". His argument is that you, as an organization have a rule. You didn't abide by your own rule and the fact that the team had apparently made its hiring decision before the actual rule was complied with indicates that the rule wasn't being adhered to "in spirit". Will that work? We'll see.
