I agree with you. But it's just my opinion as well. And courts have created this legal doctrine of "stare decisis," which they often use to punt when an issue has already been decided by SCOTUS, rightly or wrongly.

Once again, just my opinion, but I would have no confidence in this SCOTUS to overturn that decision.
