The ability to make law was reserved to Congress in the Constitution for those powers given to Congress. For those powers not given to Congress, the power to make laws was reserved to the States (10th Amendment), or to the People themselves.
Courts were set up to interpret laws and to serve as an arbiter between the states. They, and specifically SCOTUS, were not given the power to make new law, which they have been completely ignoring for the past 80'ish years.
