would you not have to prove

1. They did not follow rules set forth by the judge
2. That indeed the 12 they decided to choose were not unbiased (seems hard to prove, unless they defense objected to many of them and ran out of objections)
3. Any other potential misconduct issues that would have been resolved by sequestration

not sure what you mean by prosecution acting
