I understand it perfectly. It’s called prosecutorial discretion. Don’t have the resources to prosecute every crime, so every prosecutor has the discretion to choose what to prosecute and on what terms. Most thinking people recognize the unique status of the US Capitol and the need to prioritize prosecution of this kind of attack on it.
