The unwritten rule in the Senate had always been that the Senate would approve the nominees unless the nominee was " suspected of corruption (Abe Fortas) or thought unqualified (Harrold Carswell)".

In Bork's case, the Senators voted against him despite the fact that he was highly qualified and had no hint of corruption.
