it was the fact that they battered someone's door at 3am. I don't think there were "witnesses" - it was 1 witness...other witnesses said they heard the knock but not the announcement.

Again, they went in at 3am, looking for trouble and they found it. They never should have been there - if they were going to serve a search warrant, they should have given the resident an opportunity to answer the door. BUT we know that was never their intent because they took a battering ram to serve the warrant.
