As long as they have a majority. There is nothing in the constitution that states a limit on justices so an act of congress (without filibuster which is what Dems are planning) is all that is needed.

Usually to add a state it requires a majority of the population of the prospective state approving though. DC would surely approve. Puerto Rico has voted it down before though.
