be a valid defense for a drunk driver who is pulled over to turn the vehicle off, hop in the back seat and pass out?
After all, by the time the officer called in the plates and walked up to his vehicle:
1. he wasn’t driving;
2. he was not in physical control;
3. the car was not a moving vehicle
