capable of killing you or causing serious physical injury when used improperly.
"Use your TASER only for self defense. Avoid targeting the face, head, groin and the frontal chest area near the heart whenever possible to reduce the risk of potential serious injury or death." -Taser X26 User Manual
#2. the pat-down isn't relevant b/c Rayshard subsequently committed a strong-armed robbery and armed himself with the officer's taser.
#3.
Rayshard was turning and firing the CEW as he's running.
#4. not all tasers need to be recycled. although it's likely it would have needed a new cartridge. but I don't know what model was used. however, this too is irrelevant as the SHOT came less than 1 second after Rayshard deployed the taser at the officer. you can go frame by frame and see taser deployed until the time he falls to the ground is 1 second. so the shot is less than 1 second.
#5 you can use deadly force if there is the imminent threat of death OR serious physical injury. your "expert" conveniently left out that 2nd part. and you're under no obligation to wait to be shot for example in order to use lethal use. same holds true for the Taser. the officer was under no obligation to be tased, and possibly suffer serious physical injury, before defending himself. As soon as Rayshard's arm raised up pointing the Taser at the officer the officer was justified to use lethal force and that's exactly what he did at that precise moment. his reaction Time took 1 second.
