Who determines that vague variable?
If there is a dispute after the fact, then it would be decided by a fact finder weighing the evidence.
Where does that comport with absolute rights to life and liberty?
If someone does not have the capacity to consent to physical touching of their person, then a violation of the non-aggression principle has occurred. The rights to life and liberty don't allow you to infringe upon others' rights.

No. The rights are inalienable and natural.
