I think both are horribly wrong, but see the point of if no harm is actually done, why should there be a dramatic punishment.

My desire is for a school to have rules about contacts between teachers and students and it be handled by the schools.

Given that everyone matures in their decision making, I am not sure how you ever defend an "age".
