And all you’re doing is characterizing, I say the virus created the condition, because the college is not obligated to stand back and watch the students get sick and die without taking action. And would be rightly sued if it did. So we have a factual dispute that will probably go to a jury.

The doctrines you listed are what I was referring to, but they are all narrow, have exceptions, and are rarely applied.

Bottom line: it will be a morass of fun litigation. I’ve been representing Title IV institutions in court for a couple of decades and I’m looking forward to these cases.
