Some will. I’ve seen them.
But, first of all, over half the colleges are not owned by government. That’s not an issue as to them.
As to the state schools, I’d have to get some research done, but I suspect most states’ law will have some common law rule comparable to Force Majeure that will let them off the hook. And the state would also argue, with some plausibility, that it didn’t create the condition. The condition is the virus, and the state acted in the only way it could. But I’d get an associate to research that and don’t know the answer.
That said, summary judgment would be pretty rare, and most cases would turn on the comparable quality of the educational experience
