In Nov 2004 new rules were written in case of national emergencies. fifteen were listed. ESF-9 for example is search and rescue where FEMA is the lead agency and directs all other agencies with a coordinated effort. With Hurricane Katrina this emergency power allows broad power discretion as the clean air act was temporarily suspended due to a number of refineries that went off line.
The point is this is a very coordinated effort on the part of the government in conjunction with the states.
