If Roberts interjected himself to vote in favor of witnesses and the WH exercises their executive privilege right, the matter will end up in the courts. The Obama packed DC circuit would hear an appeal and odds are they would rule in favor of the Dems. By voting, Roberts would be placing himself in the position of having to recuse, if the case was kicked up to the SC. Roberts won't do that. Most likely, Roberts will decline to vote and the measure would fail.
