The ICIG submitted a “Matter of Urgent Concern”, the credibility which Maquire accepted and had no reason to question. Maquire had a concern if the subject matter was subject to Executive Privilege. Which is a relevant question to ask. He asked this question of the WH Counsel and the DOJ OLC. Schiff’s question, which is valid, why would you go to the same people (Trump’s WH & Barr’s DOJ) when both were the subject matter of the complaint? Especially in light of the fact that DNI’s responsibility, as required by statute, was to turn the memo over to Congress.
I believe Marquire tried to do the right thing.
Now, it cannot be subject to Executive Privilege for the simple fact it involved a conversation between Trump and a foreign leader. The foreign leader is not a member of the Executive Branch. He breaks any privilege (as a non-party).
So, WH legal Counsel and Engel (head of DOJ OLC) committed malpractice and perhaps furthered a crime.
