It depends on the level of surveillance. If the spying is limited to direct observation in a public setting, no warrant is required. However, you need a warrant to break into their physical property, mail, email, records and documents, phone conversations, etc. Before applying for the warrant the officer/agent must establish probable cause that the subject has violated a criminal statute. Comey and the FBI never established PC of an actual crime.
