The real problem here isn't criminality. The real problem here is that the FISA system can be easily abused and the folks who should be the watchers on the wall aren't equipped or willing to serve that function.
I'll give you another more everyday example. A lady makes an allegation of adult abuse and requests a restraining order, but offers few facts or one-sided evidence. It'll get granted every time because no judge wants to be the one that said "no" if something bad were to occur down the road.
