understanding of this specific campaign finance law (just like most laws) ignorance of the law is not exculpatory. What I believe you are misinterpreting and/or misrepresenting is that it would have to be proven that the offender knew that the election would be influenced by the illegal payments.

John Edwards had a hung jury because his lawyers were able to convince some juries that the payments he made were to hide the affair from his wife. Since it was a year away from the election some juries believed him.

It will be hard to prove a week from the election that Donald Trump was all of sudden trying to hide affairs from his wife.
