mention the Civil War or the Rosenbergs(they were charged with espionage). It could argued that an attempt to overthrow the government is in fact levying war against the US. It could also be argued that furnishing information to an enemy-whether or not a declared war is in fact giving them aid and comfort. That said, I have not read this thread, just saw your statement and found it much too narrow to be a definitive answer. Loved to argue either sides of issues like this in law school
