Anyone driving the car that was not named in the rental agreement is not in legal possession of the car.

Let’s say I give my keys to a valet at the hotel. I have given him permission to drive my car, correct? What if he then hands my keys to a buddy so he can take a joy ride? Is tha buddy in legal possession of my car or is it a civil matter?

If the police pull him over I sure hope they investigate a bit further when the name and address on his lisence do not match those of my car.
