In the case of land containing precious metals, the person with the most ability to bring forth mining equipment and acquire the resources would have the least incentive to go to arbitration and risk losing the right to metals. In fact, unless they were certain they would win, I would expect they would never participate.
I understand that you're not advocating anarchy. I'm just walking through scenarios where never-ending disputes would be advantageous to people.
