You've spent the day drinking beer and grilling.

Your wife parks the car, comes in and tells you the car is making a strange noise. You take the keys, go start it up to listen, no intent to drive, just identify the noise.

You happen to have a beer in hand and set it on the roof of your car and start it up. Cop rolls by and sees the beer.

DWI.

DWI laws are really poorly written.
