but the layperson who suspects malpractice is not going to have the knowledge on how to navigate the process or motivate a hospital to take a closer look. That's where an attorney and lawsuit have a role.

You're right though that a lawsuit is not necessary for a review to take place. It's just that it can facilitate the start of one and is often the impetus.
