whether violations are "secondary." The school can turn over the facts of potential violations to the NCAA, but the NCAA determines whether they are Level I, II, or III.

Your scenario would be equivalent to going to the police with evidence you committed a murder, but telling the police you should only be charged as a misdemeanor. That's simply not how it works.
