The Judiciary does not have a veto over EB policies, when the EB acts within its Constitutional authority. The District Courts, all inferior Courts are limited to the authority Congress gives them. In some matters the Courts are excluded from acting. When the courts lack jurisdiction, they have no say at all. Justice Jackson doesn't understand that. She still acts like a District Court Judge, instead of a Supreme Court Justice. I doubt she has the capacity to improve.
