There's a reason that they call it circumstantial EVIDENCE.

People can be and are convicted on circumstantial evidence if it is strong enough, and the bar for convictions in criminal trials is higher than it is for deportation hearings, and understandably so.
There was quite a bit of circumstantial evidence in Kilmar Ábrego García's case. Two different judges ruled that it was sufficient to claim that he was in fact a member of MS-13, a federally declared terrorist organization.
