AEA detainees are still subject to removal. The notice requirement will allow the terrorists to seek habeas relief, should their attorneys choose to do so. Reportedly, many had already filed and sought this method to stall deportation. But deportations under the AEA have not stopped and the SC did not halt these deportations.
