CJ Roberts in unusual stay of lower court TRO. Recently appointed (by biden) Judge Amir Hatem Mahdy Ali had assumed EB authority and ordered the Trump Admin to pay out $2 billion in USAID disbursements by midnight.

Roberts was not so much trying to avoid confrontation as he was trying to give the lower courts a chance to show that the federal judiciary is capable of acting in a non-partisan, judicial manner—to show that the system can work, that even Oboma and biden judges can act on accepted constitutional and legal principles from time to time. However, Roberts was forced to act to prevent more damage to the judiciary branch by anti-Trump judges who don’t really care about the laws and our Constitution.
