In a free market, the NCAA would be able to set whatever terms it wants for its "labor" – and the labor market would decide whether or not those terms are acceptable.
Prior to the government's regulations being enforced through lawsuits, players (labor) were willing to abide by the NCAA's terms. They could have quit and played in another league, but they voluntarily chose to accept the NCAA's terms of eligibility.
That's a free market. And it wasn't a problem until government regulations were enforced.
