1. Most of spending/laws are outside of Constitutional powers of the Federal government that is out of the window anyways
2. EOs that either spend money or become de facto laws should also be illegal, but that is out of the windows.
IMO, departments and budgets should have some sort of legislative start, and it is the Executive branch that executes what is passed and signed into law. By that definition, DOGE would be illegal, but likely so would about 50-60% of the Executive branch as well. One could argue to what level of detail, and what flexibility there can be within the laws in terms of the exact structure, budget, and payments get done, and DOGE likely can be argued to fit within that constraint.
My personal thoughts are that DOGE should be there to go through everything, and then work with Congress on updating laws as needed, so things get done legally. If there are things that are beyond the official law, then yes, that should be stopped, but the deep state has built in the gray areas.
