5 years in prison, I'd choose prison.

If it were a choice between getting paralyzed by a drunk driver or spending 5 years in prison, I'd choose prison.

So those are certainly crimes that warrant more than 5 years.

Now, I wouldn't enjoy getting raped... it would be extremely unpleasant. But if I were forced to choose, I would certainly take it over 5 years in prison.

So you're right, it is a false equivalency but in the opposite sense that you implied.
