The essence of NIL is a private individual or firm enters into a contract with a player to use the player's name, image and likeness in the privaste individual's or firm's business.

Each NIL receiptent has his own personal deal with a privaste entity or individual.

My understanding is the University, including the Athletic Department, is not a party to the transaction and never has control of the funds paid to the receiptent.
