Those laws are on the books because statistics and history show impaired drivers are indeed a much greater harm to themselves and others.
I would say a much better example would be an officer who stops a driver at noon on Saturday with no evidence of alcohol consumption. There is a half open warm beer in the rear cupholder. The officer askes and the driver says he was the designated driver the evening before and drove some friends home. One of them must have left it in the cup. While the officer could legally charge them with an open container, they use discretion to simply have them throw away the container.
