arbitrary standard you mention. Take jaywalking. To protect public safety, you cannot cross a street outside of the crosswalks and only when the signal says you may cross. That is the standard. Logic would say there is no danger to the public by crossing the street outside of the crosswalk at 3:00 am with no cars around. Logic would say you don't make the arrest. Only emotion would say you need to live by the letter of the law.

Again, you are completely backwards on this.
