They will not rule on insurrection

They can't because Trump has not been accused or convicted of insurrection in any court of law. Their ruling will be entirely based on whether a state can decide on it's own whether a person can be excluded from the ballot in that state based on a crime that has not been adjudicated in court. There is zero question they will rule that such state cannot exclude a person with no due process of insurrection. Period. The only crime would be if their vote was not 9-0.
