of nations (all of it - not just parts) is included by reference in the constitution and is thus the law of the land. Hamilton, Jefferson, Madison, Jay, Marshall all have writings about it. Law of nations is included in the constitution.
So, the only issue becomes - what does the law of nations say about immigration. Sovereign nations have a natural right to control immigration - not deny it (unless at war) but control it. The rights of the individual can outweigh the sovereignty of a nation in certain circumstances (fear for their life, loss of property, etc.) But even in these cases they must abide by rules set forth by the nation for such instances. If, and only if, they are denied entry can they enter illegally.
btw, waiting in Mexico is perfectly ok, their lives are no longer in immediate danger.
