comes down to the NCAA operates under the presumption of active and willing participation of its members of self adherence and policing. Athletic programs fight against this, but at a higher level these are academic institutions of higher learning with university presidents and chancellors and the like. There is some assumption those parties do the right thing.
ku doesn't fit within that model because its systemic the level of cheating they have set up. Their entire university, not just the basketball program or athletic department, and even the town itself and the media assigned to cover it believes ku should cheat and should not be held accountable for cheating. That is the differentiating factor as opposed to all the real NCAA member programs.
