and it's really irrelevant if he broke the law or not. His actions allowed a murder to be committed. Perhaps being suspended for a single minute might be appropriate given a mother is dead and if he had simply not brought a gun to a murder scene at 2 a.m. and instead went to bed, she would probably still be alive.
