dies as a result of Someone violating the vehicle code. If there are no traffic laws, how is vehicular manslaughter to be determined. Someone is driving 50 mph in a school zone, but there is no school zone speed limit. He kills a kid who ran out in front of his car. Had he been doing 20 mph the child would not have been killed, but since he was doing 50 the child is dead, because he didn’t have the reaction time to stop at that speed. Should he be charged with a vehiular manslaughter?

Had he been going 20 and a child darted in front of him and he was unable to stop, there would be no charges.
