There was an accident in which a train hit a dump truck recently in Missouri.
My understanding is the railroad preceded the road and the country had to get an easement to put a road across the railroad.
I'm thinking the railroad's legal responsibility is to maintain the track and train. Apparently weeds at the crossing and elevation of the ramp on the road were issues in the crash. Widow of the dump truck driver is suing. My non-lawyer mind thinks the county is responsible for the road and weeds since they sought the easement to put the road across the track.
Who is liable?
