Breaching the Capitol during the Electoral Vote Certification was not a protest, or series of protests (unlike BLM) - it was an insurrection and perhaps acts of sedition.
Trump wants to block inquiries into the events leading up to January 6th by claiming Executive Privilege, but it is not his to claim since he is no longer President. Biden has to invoke that claim of privilege, which he probably will. If adjudicated, it is unlikely that a court would upheld such a claim when crimes are sought to be covered up.
