Why would it be more involved in my scenario?

I would guess most schools would have some sort of policy around COVID-19. They could set up an waiver agreement with the families, or if they did not follow that policy, or it was determined their were flaws in the policy not considered, they would be open for liability.

None of that seems to NEED government
